So the obligations that attach to a domestic retail insurer are not automatically the obligations that attach to a wholesale reinsurer, a captive or a fund administrator. Investment business and banking sit under their own separate codes. Is it lawful to use an Indonesia-based SEO agency under PIPA?

Yes, and PIPA does not operate a prohibition on overseas processing. The Personal Information Protection Act 2016 came fully into force on 1 January 2025. Where personal information is transferred to an overseas third party, Section 15 requires the organisation to assess the level of protection that recipient provides, including the protection afforded by the law applicable to it, before making the transfer. Where a comparable level of protection is not established, the organisation must employ contractual mechanisms, corporate codes of conduct including binding corporate rules, or other means to secure it. Under Section 5(3) the organisation remains responsible for compliance throughout. There is a mechanism for a jurisdiction to be formally designated as comparable, but the Privacy Commissioner's guidance is explicit that such a designation would address only one element of Section 15, and that the organisation must still assess the recipient's own organisational, administrative and technical safeguards. Practically, that means the vendor assessment happens regardless, so we prepare for it in advance rather than treating it as an obstacle.

Where would our data be processed, and does rank or citation monitoring trigger PIPA?

We are transparent that delivery happens from Indonesia and that any personal information reaching us is an overseas transfer under Section 15. The more useful point is that most search reporting does not need personal information at all. The Privacy Commissioner's guidance states that where information has been anonymised, the transfer restrictions do not apply and it can be moved outside Bermuda freely. Rank tracking, category-level prompt monitoring and citation logging can be built entirely from public queries, corporate entity names and URLs, with no identified or identifiable individual involved. What are the penalties if PIPA is breached?

An individual who commits an offence under the Act is liable on summary conviction to a fine not exceeding 25,000 dollars, or up to two years' imprisonment, or both. An organisation is liable on indictment to a fine not exceeding 250,000 dollars. Directors and officers can be personally liable where an offence is committed with their consent or connivance, or is attributable to their neglect. Amounts are in Bermudian dollars, which are pegged at par to the US dollar. The enforcement posture has also shifted: the Office of the Privacy Commissioner's first full-year annual report, covering April 2025 to March 2026, recorded 30 written requests comprising 22 complaints and eight review requests, 25 reported personal information breaches and 43 general enquiries, and signalled a move from the education phase toward enforcement. This is general information about the statute and not legal advice; confirm your own position with Bermuda counsel and your privacy officer.

How do you measure success when we might close two mandates in a year?

By reporting visibility honestly and refusing to convert it into an invented revenue figure.
